Nous relayons par sol­i­dar­ité avec les mil­i­tants anar­chistes arrêtés, empris­on­nés et tor­turés en Azer­baïd­jan, un appel inter­na­tion­al à “faire du bruit” pour eux entre le 28 mai et le  5 juin, devant con­sulats ou ambassades.

 


Les anar­chistes azer­baïd­janais lan­cent un appel à la sol­i­dar­ité pour Bayram Mam­madov et Qiyas Ibrahi­mov, des mil­i­tants anar­chistes détenus par les autorités azer­baïd­janais­es pour avoir peint un graf­fi­ti, dis­ant “Fuck the sys­tème” et “Joyeux jour des esclaves”, sur le mon­u­ment dédié à l’an­cien prési­dent défunt Hey­dar Aliyev, en guise de protes­ta­tion con­tre les injus­tices inces­santes per­pétrées par les élites dirigeantes.

Cela a été fait la veille de l’an­niver­saire de la mort de Hey­dar Aliyev le 10 mai 2016, annuelle­ment célébré par le gou­verne­ment de manière osten­ta­toire. Compte tenu du culte de la per­son­nal­ité absolue de Aliyev, un tel acte a été sévère­ment con­damné par le gou­verne­ment (sous la direc­tion de son fils Ilham Aliyev) et les mil­i­tants ont été arrêtés immé­di­ate­ment. La police a placé sur eux de la drogue, évi­tant ain­si l’ac­cu­sa­tion pour sim­ple motif de hooliganisme.

Ce dernier est pas­si­ble d’une peine d’emprisonnement allant jusqu’à un an max­i­mum (ce qui, pour le régime Aliyev est une peine « trop légère »), tan­dis que les charges rel­a­tives à la pos­ses­sion illé­gale d’héroïne sont pas­si­bles d’un max­i­mum de douze ans d’emprisonnement. Le fait même que la police ait “décou­vert” près de trois kilos d’héroïne en pos­ses­sion de cha­cun des détenus au moment de l’ar­resta­tion atteste le fait que l’af­faire a été inven­tée de toutes pièces (penseriez-vous qu’une per­son­ne saine d’e­sprit se promèn­erait en ville avec une telle quan­tité d’héroïne cachée dans les poches ?).

Le 12 mai, un tri­bunal a ordon­né leur déten­tion pour une péri­ode de qua­tre mois. Toute­fois, s’ils sont recon­nus coupables, ils risquent jusqu’à douze années d’emprisonnement. Bayram et Qiyas ont été sévère­ment tor­turés avant et après l’au­di­ence au tri­bunal. Leur avo­cat Elchin Sadigov a partagé via Face­book, l’ex­posé détail­lé de Bayram sur les tor­tures qu’il a endurées au 12ème Départe­ment de police de Bak­ou et au Cen­tre de police de la Ville de Bakou.

Ci-dessous, la tra­duc­tion de la déc­la­ra­tion de Bayram:

Le 10 mai 2016, aux envi­rons de 14–15 heures, 3 per­son­nes en tenue civile, m’ont for­cé à mon­ter à bord d’une voiture blanche du type Jeep et m’ont emmené au 12ème Départe­ment de police. On m’a amené au bureau de l’Of­fici­er en Chef. Il y avait 7–8 officiers en civ­il. Ils ont immé­di­ate­ment com­mencé à me frap­per à coups de poings, me gifler et me ruer de coups de pieds. Ils me demandaient pourquoi j’avais pris en pho­to le graf­fi­ti, qui était mon asso­cié, et ain­si de suite. Cepen­dant, je n’é­tais pas en mesure de répon­dre à leurs ques­tions car j’ai per­du con­nais­sance. On m’a amené au Cen­tre de police de la Ville de Baku dans une voiture incon­nue. J’ai été bat­tu à nou­veau et for­cé de recon­naître les chefs d’ac­cu­sa­tion en matière de stupé­fi­ants. Je leur ai dit que je n’avais jamais vu de stupé­fi­ants de ma vie et qu’on ne peut pas m’ar­rêter pour avoir pris une pho­to. Cela les a amenés à me bat­tre encore plus fort et exiger de moi d’ac­cepter les charges. Ils m’ont cou­vert d’in­jures et insulté. Ils ont bais­sé mon pan­talon et m’ont men­acé avec une matraque col­lée à moi de façon « immorale ». Voilà pourquoi je devais accepter les charges. Et j’ai du “avouer” un témoignage tel qu’ils le voulaient.

Ensuite, on m’a emmené au bureau d’un général et on m’a dit que «si tu dépos­es des fleurs devant l’É­tat et par­le à AzTV, présentes tes excus­es à la stat­ue, tu seras libéré”.

J’ai refusé ça, alors ils m’ont bat­tu à nou­veau. On m’a amené au Cen­tre de déten­tion pro­vi­soire de Nari­manov. Le 11 mai au matin, l’Of­fici­er en chef m’a ordon­né de net­toy­er la cour, ramass­er les mégots de cig­a­rettes. J’ai refusé et il a com­mencé à me frap­per à coups de poing et me gifler. Je refu­sais tou­jours alors il a ordon­né à ses hommes de pren­dre une matraque et de l’en­fon­cer en moi et a pris une pho­to. Je devais accepter à nou­veau. On m’a don­né un bal­ai et une pelle, ils ont pris ma pho­to. Le tabas­sage est devenu quotidien.

Après l’au­di­tion à la cour du 12 mai, ils m’ont emmené au bureau du chef du Cen­tre de déten­tion pro­vi­soire. Il y avait deux per­son­nes en civ­il. On m’a dit de révéler cer­tains noms et de les ren­dre coupable de tra­vailler avec moi. On m’a dit de met­tre des fleurs en face de la stat­ue, de par­ler à AzTV et qu’ils me libér­eraient avant qu’il ne soit trop tard. Je refu­sais cela et ils ont téléphoné à quelqu’un à qui ils ont dit «prends soin de lui pen­dant quelques temps”. Ils m’ont fait descen­dre plusieurs étages. J’é­tais menot­té pen­dant qu’ils me bat­taient à coups de poing, coups de pied et de matraque.

Ils ont même enchaîné mes pieds, ils ont neu­tral­isé ma bouche pour que per­son­ne ne m’en­tende quand ils me battaient.

Ils ont vu que les menottes et les chaînes lais­saient des mar­ques de tor­ture sur moi, ils m’ont alors scotché les mains et les jambes dans mon dos. Ils m’ont mis con­tre le sol, l’un d’en­tre eux m’a tenu un pieds tan­dis que l’autre le bas­ton­nait. Puis ils m’ont relevé pour me relâch­er d’un coup, me lais­sant retomber à plusieurs repris­es. Après 4 ou 5 fois, les ban­des ont été déchirées et cette fois ils ont com­mencé à m’écras­er les mains avec leurs jambes. L’autre con­tin­u­ait de me fou­et­ter le pied. Ensuite, ils m’ont frap­pé la poitrine et les genoux avec le manche d’une matraque. Je per­dais con­nais­sance et ils m’ont lais­sé à terre. Eux aus­si étaient fatigués. Ils ont mis une feuille de papi­er blanc sur moi et m’ont dit que s’ils la voy­ait tomber, ils me bat­traient à nou­veau. Ils l’ont fait par la suite.

Après un cer­tain temps, ils ont exigé de moi de net­toy­er les toi­lettes. Quand j’ai refusé ça ils ont com­mencé à me bat­tre plus fort, cette fois en me fil­mant avec une caméra.

J’ai per­du con­nais­sance après ça, ils m’ont réveil­lé en ver­sant de l’eau sur moi. Ils m’ont emmené à ma cel­lule alors que j’é­tais pieds nus. En ce moment j’ai beau­coup d’ec­chy­moses sur les bras, les jambes et les genoux à cause de la tor­ture. Des con­tu­sions ouvertes sur les mains et les poignets. J’ai tou­jours un trau­ma­tisme crânien. J’ai des plaies ouvertes sur les jambes aus­si. La plu­part du temps mon urine est san­guino­lente, j’ai d’a­tro­ces douleurs à la bouche quand que je mange, ma poitrine, mes côtes, mes bras, mes jambes … chaque par­tie de moi me fait souffrir.

Ce n’est pas la pre­mière fois que les autorités exi­gent des mil­i­tants en Azer­baïd­jan de présen­ter des excus­es pour leurs actes devant des mon­u­ments de Hey­dar Aliyev et d’y dépos­er des fleurs. Comme James C. Scott l’a men­tion­né, “Le remord, les excus­es, deman­der par­don, et glob­ale­ment, effectuer des amendes sym­bol­iques, sont un aspect bien plus fon­da­men­tal dans presque tous les proces­sus de dom­i­na­tion, que la puni­tion elle-même. Ce qu’of­frent tous ces acteurs (à tra­vers les excus­es) est une démon­stra­tion de l’af­fir­ma­tion dis­cur­sive par le bas, ce qui est d’au­tant plus utile, car elle con­tribue à l’im­pres­sion que l’or­dre sym­bol­ique est volon­tiers accep­té par ses mem­bres les moins favorisés.”

Les Aliyev ont appau­vri la nation et exploité des per­son­nes, ain­si que les ressources du pays pour leur pro­pre béné­fice pen­dant plus de deux décen­nies. Pen­dant ce temps, ils ont été intolérants à toute dis­si­dence poli­tique, et ont sévère­ment opprimé les dis­si­dents, usant de leur dis­posi­tif de sécu­rité massif.

Nous appelons à la sol­i­dar­ité de nos cama­rades d’Eu­rope et d’ailleurs pour Bayram et Qiyas et à pro­test­er con­tre leur déten­tion illé­gale et la tor­ture, devant les ambas­sades et con­sulats azer­baïd­janais de vos pays, exigeant leur libéra­tion immédiate.

Azer­bay­can­lı anarşistler, Azerbaycan’ın ölmüş cumhur­başkanı Hay­dar Aliyev’in anıtı­na, yöneten elit­lerin gerçek­leştirdiği adalet­si­z­lik­leri protesto etmek için “Fuck the sys­tem” ve “Mut­lu kölel­er günü” yazıla­maları yap­tık­ları için otoritel­er tarafın­dan tutuk­lanan anarşist eylem­cil­er Bayram Mam­madov ve Qiyas Ibrahi­mov ile dayanış­ma çağrısı yap­tılar. Bu eylem, her yıl hükümet tarafın­dan müs­rif bir şek­ilde kut­lanan 10 Mayıs 2016 gece­si yani Hay­dar Aliyev’in doğumgününde yapıldı. Aliyev mut­lak kült bir kişi­lik olduğu için, böyle bir eylem hükümet tarafın­dan (oğlu İlh­am Aliyev’in başkan­lığın­da­ki) sert bir şek­ilde kınandı ve eylem­cil­er 10 Mayıs 2016’da gözaltı­na alındı. Polis onları holi­gan­lık gerekçeleriyle suçla­mak­tan kaçı­narak üzer­ler­ine uyuş­tu­ru­cu yerleştirdi.

Holi­gan­lık bir yıla kadar hap­si gerek­tiriy­or (Aliyev’in rejim için “çok hafif” bir ceza), ancak yasadışı eroin kul­lan­mak 12 yıl hapse kadar cezaları içeriy­or. Polisin gözaltı sırasın­da her iki kişide yak­laşık 3 kg eroin “bul­muş” olması olayın tam bir düzmece olduğu­nun ispatıdır (aklı olan kişi şehrin ortasın­da cebinde o kadar eroin­le dolaş­mazdır her­alde). 12 Mayıs’ta, mahkeme dört aylık tutuk­lu­luk süre­si ver­di. Beni aşağılıy­or, hakaret ediy­or­lardı. Pan­tolon­u­mu çıkardılar ve copla tecavüz tehdidinde bulun­du­lar. Suçla­maları bu yüz­den kab­ul ettim. Ve onların iste­diği gibi bir iti­raf­name yazdım.

Son­rasın­da beni bir gen­er­alin ofi­sine götürdüler ve “eğer heyke­lin önüne çiçek koyarsan ve AzTV’ye konuşup, özür dil­ersen serbest bırakıla­cak­sın” dediler.

Bunu red­det­tim, ardın­dan bana tekrar vur­du­lar. Nari­manov Geçi­ci Gözaltı Merkezine(nezarethanesine) bırak­tılar. 11 mayıs sabahı, komiser avluyu tem­i­zle­me­mi sigara izmar­it­leri­ni topla­mamı emret­ti. Red­ded­ince yum­ruk­la­maya, tokat atmaya başladı. Tekrar red­det­tim ve adamı­na copla tecavüz etmesi­ni emret­ti ve fotoğrafını çek­ti. Yeniden kab­ul ettim.. Bana bir süpürge ve faraş verdil­er, yine fotoğrafımı çek­til­er. Gün­lük olarak işkence etm­eye başladılar.

12 mayıs­ta­ki duruş­madan son­ra, beni nezarethane başkomis­erinin ofi­sine götürdüler. Ofis­te­ki siv­il giy­im­li iki kişi, ben­den bir kaç isim ve bu isim­leri ben­im­le çalış­mak­la suçla­mamı iste­di. Heyke­lin önüne çiçek koy­mamı, AzTV’ye konuş­mamı ve çok geç olmadan beni tem­ize çıkara­cak­larını söyledil­er. Kab­ul etmey­ince birine tele­fon açıp “bir süre için ona göz kulak olun” dedil­er. Daha alt kat­lara götürdüler. Bana yum­ruk, tekme ve jopla vuru­lurken eller­im bağlıydı.

Ayak­larımı bile zin­cirledil­er, ağzımı tıkadılar. Bu yüz­den işkence edilirken kimse beni duyamıyordu.

Kelepçelerin ve zin­cir­lerin bende işkence izi bırak­tığını gördük­ten son­ra eller­i­mi ve ayak­larımı arkadan bant­ladılar. Beni yere yatırdılar ve biri ayak­larım­dan tutarken diğeri beni falakay yatırdı. Son­ra beni havaya kaldırarak bir anda yere bırak­tılar ve bunu bir çok kez tekrar­ladılar . 4–5 defadan son­ra üzer­imde­ki bant­lar parça­landı bu seferde eller­ime bacak­larıy­la bastır­maya başladılar. Bu sıra­da diğeri hala falakay­la meşguldü. Göğsüme yum­ruk attılar ve diz­ler­ime bas­to­nun arkasıy­la vur­du­lar. Bil­inci­mi kay­bet­m­eye başladığım­da bırak­tılar. Onlar da yorul­muş­tu. Üzer­ime beyaz bir kağıt koy­du­lar ve kağıdın yere düşme­si duru­mun­da beni tekrar döve­cek­leri­ni söyledil­er. Bu son­radan zat­en gerçekleşti.

Bir süre son­ra tuvaleti tem­i­zle­me­mi iste­dil­er. Bunu red­ded­ince beni daha sert dövm­eye başladılar. Bunu da filme kaydettiler.

Bun­dan son­ra bil­inci­mi kay­bet­tim, üzer­ime su dök­erek uyandırdılar. Beni yalı­nayak hücr­eye götürdüler. Şim­di işkence­den dolayı kol­larım bacak­larım ve göğsüm çürük­ler­le dolu. Açık yaralar dirsek ve eller­imde. Hala beyin trav­ması geçiriy­o­rum. Bacak­larım­da da açık yaralar var. idrarım genelde kan­lı ve yemek yerken ağzım­da büyük bir acı var. bacak­larım göğsüm kol­larım eller­im… her yer­im büyük acı içinde.

Otoritelerin Azerbaycan’daki aktivistler­den Hey­dar Aliyev heykel­leri önünde af diley­erek çiçek bırak­malarını istemeleri ilk defa karşılaşılan bir şey değil. James Scott’ın da söylediği gibi “ piş­man­lık, af dileme, özür dileme ve genel olarak sem­bo­lik düzelt­mel­er ege­men­liğin her anın­da ceza­landır­madan daha hay­ati bir unsur­dur… bu aktör­lerin özür yoluy­la ulaş­mak iste­dik­leri, aşağı­dan gelen tutarsız bir tasdiktir.

Aliyev aile­si bu ülkeyi güçsü­zleştirdiği gibi, insan­ları ve doğal kay­nakları ken­di çıkar­ları için sömürmek­te­dirler. Her tür poli­tik karşı çıkışa müsama­ha göster­medik­leri gibi, güven­lik aygıt­larıy­la muhal­ifleri baskı altın­da tutmaktadır.

Avrupa’da ve baş­ka yer­lerde­ki bütün yoldaşlarımızı Bayram ve Qiyas’la dayanış­ma göster­m­eye, ve onların ille­gal bir şek­ilde hapsedilmeler­ine ve işkence görmeler­ine karşı Azer­bay­can kon­solosluk­ları önünde eylem yap­maya ve serbest bırakıl­malarını talep etm­eye çağırıyoruz.

Azer­bai­jani left­ists call for sol­i­dar­i­ty with Bayram Mam­madov and Qiyas Ibrahi­mov, anar­chist activists that have been detained by the Azer­bai­jani author­i­ties for paint­ing a graf­fi­ti, say­ing “Fuck the sys­tem” and “Hap­py slaves’ day”, on the mon­u­ment to the deceased for­mer pres­i­dent Hey­dar Aliyev in an act of protest against the con­tin­ued injus­tices per­pet­u­at­ed by the rul­ing elites. This was done on the eve of Hey­dar Aliyev’s birth­day on May 10, 2016, which is annu­al­ly being cel­e­brat­ed by the gov­ern­ment in a waste­ful man­ner. Giv­en an absolute per­son­al­i­ty cult of Aliyev, such an act was severe­ly con­demned by the gov­ern­ment (under the lead­er­ship of his son Ilham Aliyev) and the activists were arrest­ed on May 10, 2016. Police have plant­ed drugs on them to avoid charg­ing them on the grounds of hooliganism.

The lat­ter is pun­ish­able by impris­on­ment only up to a year (which for the Aliyev’s regime is “too mild” of a pun­ish­ment), while the charges on ille­gal pos­ses­sion of hero­in are pun­ish­able by up to twelve years of impris­on­ment. The fact that the police have “dis­cov­ered” near­ly three kg of hero­in in each of the detainee’s pos­ses­sion at the moment of arrest tes­ti­fies to the fact that the case has been fab­ri­cat­ed (a sane per­son wouldn’t be hang­ing around the city with that much hero­in hid­den in pock­ets, would he?). On May 12, a court ordered their deten­tion for a peri­od of four months. How­ev­er, if con­vict­ed they face up to twelve years of impris­on­ment. Bayram and Qiyas have been severe­ly tor­tured both before and after the court hear­ing. Their lawyer Elchin Sadigov has shared via Face­book Bayram’s detailed state­ment on tor­tures con­tin­u­ous­ly faced by him at the 12th Police Depart­ment in Baku and the Baku City Police Cen­ter. Below is the trans­la­tion of Bayram’s statement:

On 10 may 2016, around 14–15:00 3 per­son with civil­ian out­fits forced me to get on white “Jeep” mod­el car and took me to 12th Police Depart­ment. They brought me to chief officer’s office. There were 7–8 offi­cers in civil­ian out­fit. They imme­di­ate­ly began to punch, slap and kick me. They were ask­ing me why I took pic­ture of graf­fi­ty, who is my asso­ciate and so on. How­ev­er, I weren’t able to answer their ques­tions as I lost my con­scious­ness. They brought me to Baku City Police Cen­ter by an unknown car. I’ve been beat­en again and told to accept the nar­cot­ic relat­ed charges. I told them that I’ve nev­er seen nar­cotics in my life and you can’t arrest me for tak­ing a pho­to, this caused them to beat me hard­er and demand to accept the charges. They were curs­ing and insult­ing me. They took my pants off and threat­ened me with using baton “immoral­ly” on me, that’s why I had to accept the charges. And I had to “con­fess” a tes­ta­ment what they wanted.

Then, they brought me to a general’s office and told me that “if you put flow­ers in front of state and talk to AzTV, apoli­gize to stat­ue you will be released”.

I refused this, then they beat me again. They brought me to Nari­manov TDC (Tem­po­rary Deten­tion Cen­ter). On 11 May morn­ing, chief offi­cer ordered me to clean the yard, pick up the cig­a­rette butts. I refused and he start­ed to beat me with punch­ing and slap­ping. I refused again and he ordered his men to pick up a baton and force it into me and then took pho­to. I had to agree again. They gave me a broom and a dust­pan, took my pho­to. These beat­ings began to be daily.

After court hear­ing in 12 May, they took me to TDC chief’s office. There were 2 peo­ple in civil­ian clothes, they told me to spell some names and accuse them to work with me. They told me to put flow­ers in front of stat­ue, talk to AzTV and they would release me until it’s not too late. I refused this and they phoned some­one and told him “take care of him for a while”. They took me to low­er floors. I was hand­cuffed as they were beat­ing me with punch­es, kicks and batons.

They even shack­led my foots, they tamed my mouth so no one would hear me while they beating.

They saw that hand­cuffes and shack­les made a tor­ture sign on me, so they taped my hands and legs to my back. They put me on ground, one of them was hold­ing my foot while the oth­er one was mak­ing basti­na­do. Then they took me high­er and releas­ing me sud­den­ly, caus­ing me to fall sev­er­al times. After 4 or 5 times, tapes were torn apart and this time they start­ed to rum­ple on my hands with their legs. Oth­er one was still foot whip­ping me. Then they punched my chest and knees with back of a baton. I was los­ing my con­sciense and they put me down. They were tired too. They put a white paper on me and told me that if they see this one falling they will beat me again. They did so afterwards.

After a while, they demand­ed from me to clean the toi­let. When I refused this, they start­ed to beat me more hard­er, this time while film­ing me with a camera.

I lost my con­scious­ness after that, they woke me up by pour­ing water on me. They took me to my cell while I was bare­foot­ed. Right now I have many bruis­es on my arms, legs and knees because of tor­ture. Open bruis­es are on my hands and wrist. I still have head trau­ma. I have open wounds on my legs too. My urine is most­ly with blood, my mouth caus­es me heavy pain while I eat, my chest, ribs, arms, legs… every part of me hurts.

It is not the first time that the author­i­ties are demand­ing from the activists in Azer­bai­jan to apol­o­gize for their acts in front of Hey­dar Aliyev’s mon­u­ments and lay flow­ers to it. As James Scott has men­tioned “Remorse, apolo­gies, ask­ing for­give­ness, and gen­er­al­ly, mak­ing sym­bol­ic amends are a more vital ele­ment in almost any process of dom­i­na­tion than pun­ish­ment itself… What all these actors offer (through the apol­o­gy) is a SHOW of dis­cur­sive affir­ma­tion from below, which is all the more valu­able since it con­tributes to the impres­sion that the sym­bol­ic order is will­ing­ly accept­ed by its least advan­taged mem­bers.” The Aliyevs have been impov­er­ish­ing the nation and exploit­ing the peo­ple as well as the country’s resources for their own ben­e­fit for more than two decades. Mean­while they have been intol­er­ant of any polit­i­cal dis­sent, severe­ly oppress­ing the dis­senters through their mas­sive secu­ri­ty apparatus.

We call on our com­rades in Europe and else­where to stand for sol­i­dar­i­ty with Bayram and Qiyas and protest against their ille­gal impris­on­ment and tor­ture in front of Azer­bai­jani embassies and con­sulates in your coun­tries, demand­ing for their imme­di­ate release. 

Please also dis­sem­i­nate this call among as many peo­ple as possible.
