Liberté pour le journaliste Aziz Oruç

Aziz Oruç est journaliste. Né en 1984 à Diyarbakır, il est père de deux enfant. Il exerce le métier de journaliste depuis 7 ans, dans différentes villes de Turquie et du Kurdistan. Son nom est venu à l’actualité à travers les informations qu’il a relayées, ainsi que ses déclarations pour ses collègues emprisonné.e.s.

Oruç a été placé en garde-à-vue lors d’une opération de police, le 11 décembre 2019, à Doğubayazıt, district d’Ağrı, en Turquie. Malgré le fait qu’il soit connu en Turquie, comme journaliste, et que les dossiers ouverts à son encontre concernent seulement son activité journalistique, il a été désigné comme cible, par le Ministère des affaires intérieures turc et les médias du pouvoir, à travers des articles titrés tels que “Un terroriste a été arrêté à la frontière iranienne”.

Oruç est détenu en garde-à-vue depuis 7 jours, à la Direction de la Sécurité d’A?r?. Alors qu’il a subi des tortures, il n’a pas été soigné par les médecins de l’hôpital où il a été amené et il n’a toujours pas été autorisé à voir sa famille. Le délai de garde-à-vue d’Oruç a été également prolongé jusqu’au mercredi 18 décembre.

Le journaliste Aziz Oruç, a partagé ce qu’il a enduré, avec l’opinion publique, par l’intermédiaire de ses avocats. Il a décrit la torture qu’il a subie, et la violation de la Convention relative au statut des réfugiés :
“La police de l’Arménie m’a mis en gare-à-vue, en prétendant que mon passeport était faux. Ils m’ont enfermé dans une pièce durant des heures. Ils m’ont menacé et violenté. Je leur ai affirmé que je suis journaliste, et qu’en ayant été condamné à de la prison en Turquie, je voulais passer en Europe. J’ai demandé asile en Arménie, auprès des personnes qui me retenaient dans cette pièce. Mais, toutes mes demandes ont été refusées avec des menaces. Ils m’ont menotté et menacé en me disant ‘on va te livrer à l’Iran, pour qu’ils te pendent là-bas’. Puis, ils m’ont envoyé en Iran, et livré aux services de renseignements iraniens. Eux m’ont mis en garde-à-vue pendant deux jours, puis présenté devant un tribunal. La décision prise fut une condamnation à verser 1 million 800 mille tomans iraniens, et  d’être expulsé. Ils m’ont laissé en pleine nuit, à la frontière Turquie- Iran, au milieu de barbelés. Ils ont voulu que je traverse les barbelés et que j’entre en Turquie clandestinement. Malgré toute mon opposition, ils m’ont jeté à travers les barbelés, sur le sol turc. Maintes et mainte fois, je suis revenu sur mes pas, sur le sol iranien, et j’ai demandé à entrer en Turquie légalement, ils ne me l’ont pas permis. J’ai été blessé par les barbelés. Ils m’auraient laissé mourir là-bas…  Je suis alors revenu à Doğubayazıt.
L’Iran et Arménie n’ont pas accepté ma demande et ont violé mon droit international d’asile, c’est un crime à l’encontre du Droit international. Nous allons solliciter des tribunaux internationaux.”

Actuellement, les 110 des 130 journalistes emprisonné.e.s dans les pays membres du conseil d’Europe, se trouvent en Turquie. Avec les arrestations, gardes-à-vue, condamnations au contrôle judiciaire, interdictions de quitter le territoire, la Turquie s’est transformée pour les intellectuel.le.s, universitaires, politiques et journalistes, en une prison à ciel ouvert. 110 journalistes ont été arrêté.e.s et emprisonné.e.s, mais aussi, par ailleurs des dizaines de journalistes on été obligé.e.s de s’exiler dans différents pays du monde, et autant sont encore entre les mains de passeurs, pour pouvoir quitter la Turquie.

Rappelant que le droit d’asile de chaque personne est assuré par la “Convention relative au statut des réfugiés”, nous voulons rappeler que l’Arménie et l’Iran ont violé ce droit et commis un crime d’absence d’humanité. Nous exprimons que, contre cette illégalité, nous sommes en solidarité avec notre confrère Oruç, et nous suivrons son cas, de près.

Nous, journalistes qui signons cet appel, avons vu pour beaucoup d’entre nous nos libertés limitées dans les pays où nous travaillions. Nous avons été pour certainEs jugé.e.s pour nos écrits, torturé.e.s, emprisonné.e.s. CertainEs d’entre nous, n’ayant pas de sécurité de vie, ont été obligéEs de quitter leur pays. Nous avons été obligé.e.s de nous exiler.

Plus le silence continue face à l’illégalité et les crimes contre l’humain, plus les tortures, gardes-à-vue, arrestations, oppressions et exils se multiplient. Pour cette raison, en tant que journalistes, nous dénonçons, les violations de droits, crimes commis, et déclarons que nous allons suivre ce cas attentivement.

Pour que le processus que notre confrère Oruç est en train de vivre prenne immédiatement fin, pour qu’il soit libéré, et pour que les journalistes ne subissent plus les mêmes oppressions, nous appelons à la solidarité de toutes les institutions et organisations de journalisme et de protection des journalistes, les syndicats, le Conseil des droits de l’homme des Nations unies, Le Parlement européen, et toutes les organisations de droits humains.

Freedom for Aziz Oruç

Aziz Oruç was born in Diyarbakır in 1984 and is the dad of two children. He worked for seven years in many cities of Turkey and Kurdistan. He was used to coming to the fore many times, due to writing the news and articles, and statements regarding the imprisoned journalists. Oruç was detained during an operation in Doğubayazıt the district of Ağrı Province of Turkey, on 11 December.

The courts hold an inquiry against him, because of his journalism. But the Turkish Interior Ministry and the media organs of the government make Oruç scapegoat, by saying “A terrorist is arrested in the border of Iran.” Oruç is detaining in the police office of Ağrı for seven days. Although he is tortured, the doctors did not treat him in the hospital and till now his family could not see him. Oruç’s detention period was extended until Wednesday, December 18th.

Journalist Aziz Oruç informed about his situation to his lawyer. He told his lawyer about the torture in the border of Iran, Turkey and Ermenistan and violation of the International Refugee Rights Convention and says;
“The Armenian guards claimed that my passport is fake and arrested me. They left me in a room and locked the door. I was threatened and tortured. I told them that I am a journalist and was sentenced to prison in Turkey and want to go to Europe. I requested my asylum rights in Armenia. But they answered my request with a threat They said ‘We are going to put you in handcuffs, we do not care even if they execute you. Then I was sent to Iran and was given to intelligence service. I was detained again and after two days I was taken to court. I was sentenced to 800 thousand Iran Tumen, then they decided to deport me. They took me to Iran- Turkey border and asked me to cross the wire netting of the border. I was forced to pass the wire netting of the border and they threw me inside Turkey border. Although I tried many times to go back inside the Iran border, to come back in a legal way to Turkey, they did not let me. I was injured during crossing the wire nettings. I was left to die. Then I came to Doğubayazıt. Iran and Armenia committed a crime by rejecting my asylum request.
Both Armenia and Iran countries broked international law by doing all those to me. That’s why we are going to make an application to international courts.”

With today’s conditions, 130 journalists are imprisoned in the countries in Europe Council members. 110 of the are imprisoned in Turkey. Because of detentions, arrests, judicial control decisions and forbidding journeys to other countries, Turkey is an open prison for the intellectuals, academicians, politicians, and journalists. 110 journalists are imprisoned in Turkey. That’s why many other journalists forced to leave Turkey and they are surrounded by human smugglers. We would like to remind you that everybody has the right to have an asylum request to another country. That’s why Iran and Armenia committed an international crime. We are going to support and solidary our colleague Oruç against the unlawful situation.

The freedoms of most of the journalists who signed that text were restricted in the countries in which we worked. We were judged due to our news and articles, we were tortured and imprisoned. Most of us left our countries because our lives were unsafe and we were in danger. Most of us had to seek asylum in different countries. If we stay silent against the lawlessness and crimes against humanity, that will increase torture, detention, arrests, oppression, and exiles. Therefore, we, as journalists, condemn the violations of the international rights committed against humanity and state that we will be the followers of this event.

We call upon all of journalism’s and journalists’ right organizations, corporations and institutions, and the United Nations Human Rights Council, EU Parliament and all of other human rights organizations to immediately end the unlawful process experienced against our colleague Oruç and to release him. We demand that these organizations institutions take action to prevent such incidents from happening again.

Aziz Oruç sala 1984 li Amedê ji dayik bû û bavê du zarokan e. Heft sal li gellek bajarên Kurdistan û Tirkiyeyê karê rojnamevaniyê kir. Bi nûçe û daxuyaniyên xwe yên derbarê rojnamevanên girtî de gellek caran hate rojevê. Oruç di operasyoneke li navçeya Bazîda Agiryê hate binçavkirinç

Her çendî tê zanîn weke rojnamevan li Tirkyeyê xebitiye, ji ber karên wî yên rojnamevaniyê ketiye ber lêpirsînên dadgehan, Wezareta Navxweyî ya Tirkiye û çapemeniya nêzîkî desthilatiyê bi daxuyaniya “Li sînorê Îranê terorîstek hat girtin” ew kirin hedef. Ev heft roj in Oruc li Midûriyeta Emniyeta Agiriyê tê ragirtin. Her çendî hate îşkencekirin, ew li nexweşxaneyê ji aliyê bijîşkan ve nehate dermankirin û heta niha malbata wî nikariye wî bibînin. Rojnamevan Azîz Oruç tiştên ku hatine serê wî bi rêya parêzerê/a xwe ji raya giştî re ragihand. Wiha behsa Îşkenceya ku li Îran, Ermenîstan û Tirkiyeyê dît û binpêkirina Peymana Mafê Penaberiya Navdeweletî kir:
“Polîsên Ermenîstanê ji min re gotin passaporta te sexte ye. Ez bi saetan di odeyekê de hatim kilîdkirin. Gellek caran gef li min xwarin û li min xistin. Min ji wan re got ku ez rojnamevan im, li Tirkiyeyê bi cezayê girtîgehê têm darezandin û min daxwaza mafê penaberê yê ji Ermenîstanê kir. Ji min re gotin em ê te radestê Îranê bikin, ew te îdam jî bikin ne li xema me ye. Piştre ez radestê rêxistina îstîxbaratê ya Îranê hatim kirin. Piştî binçaviya du rojan, min derxistin pêşberê dadgehê û 800 hezar Tumenê Îranê ceza li min hate birrîn. Paşê biryar dan ku min dersînor bikin. Min anîn ser sînorê Tirkiyeyê û ji min xwestin ku ez têlên sînorê Tirkiyeyê derbas bikim. Piştre min bi darê zorê avêtin nava sînorê Tirkiyeyê. Min gellek caran xwest careke din derbasî Îranê bibim, daku bikarim bi awayeke fermî vegerim Tirkiyeyê. Lê belê rê nedan min û wana ez bi mirinê re rû bi rû hiştim. Piştre ez hatim Bazîdê.
Ermenîstan û Îranê bi qebûlnekirina mafê min ê penaberiyê hiqûqa navneteweyî binpê kirin. Polîtîkayên her du welatan ên li hemberî min li dijî hiqûqa navneteweyî ne. Em ê li dadgehên navneteweyî doz li wan vekin.”

Li gel şert û mercên îro, li welatên endamên Konseya Ewropayê 130 rojnamevan girtî ne. Ji vana 11 li Tirkiyeyê girî ne. Ji ber girtin, binçavî, konrolkirinê edlî û qedexeyên mafê gerê ya derveyê welêt, hema bêje Tirkiye ji bo rojnamevan, akademîsyen, ronakbîr û siyasetmedaran bûye girtîgeheke vekirî. Ji ber van bêmafiyan gellek rojnamevan ji welatên xwe derketine û ketine nava destê qaçaxçiyên navneteweyî. Em careke din dixwazin bi bîr bînin ku mafê her kesê yê penaberiyê heye û hev ji aliyê Hevpeymana Penaberiyê ya Navneteweyî ve hatiye parastin. Bi vî awayî, em van binpêkirinên mafan ên Ermenîstan û Îranê şermezar dikin. Em ê her tim li dijî vê bêhiqûqiyê bi hevkarê xwe Azîz Oruç re di nava piştigrî û piştevaniyê de bin.

Piraniya rojnamevanên ku navên wan li binê vê daxuyaniyê ne, em li welatên ku lê xebitîne rastî binpêkirina maf û azadiyan hatine. Em ji ber nivîsên xwe hatine darizandin, me îşkence dît û em hatin cezakirin. Ji ber ku tu ewlehiya can û jiyana me li welatên me nemabû, em neçar man ku welatê xwe bi cih bihêlin. Piraniya me neçar man ku daxwaza mafê penaberiyê li welatên cûda bikin. Heta ku bêdengiya li hemberî bêmafî û sucên li dijî mirovahiyê tên kirin berdewam bike, dê binçavkirin, girtin, zext û dersînorkirin jî zêdetir bibin. Ji ber vê çendê, em weke rojnamevanan, em vê pêvajoya bêmaf a li hemberî hiqûqa mirovayê tê kirinê şermezar dikin û em dest ji şopandina vê pêvajoyê bernedin.

Ji bo ev pêvajoya dijî hiqûq û mafê mirovan bi dawî bibe, hevkarê me Azîz Oruc serbest were berdan û ji bo careke din bûyerên bi vî rengî neqewimin; em bang li hemû rêxistin û saziyên mafên rojnamevan û rojnamevaniyê, Konseya Mafê Mirovan a Neteweyên Yekbûyî, hemû sendîka û Parlementoya Ewrojayê dikin ku hewl bidin û vê bûyerê bişopînin.
